Terms & Conditions.

These Terms & Conditions ("Terms") form an agreement between you and East Tennessee School of Real Estate ("the School," "we," "us"). By creating an account, enrolling in a course, purchasing a membership, or otherwise using this website, you agree to these Terms and to our school policies, which are incorporated here by reference.

If you do not agree, do not enroll or use the site. If you are enrolling on behalf of a brokerage or firm, you represent that you are authorized to bind that organization.

You must be at least 18 years old to create an account. You agree to provide accurate, complete registration information — including your legal name as it will appear on TREC filings — and to keep it current.

Your login is personal and non-transferable. You may not share credentials, allow another person to complete coursework attributed to you, or permit anyone else to sit in your place during a proctored or streamed session. Because course completion is reported as state-required education, credential sharing is treated as academic fraud and will result in immediate termination of access without refund, voiding of any certificate issued, and reporting to the Tennessee Real Estate Commission where appropriate.

You are responsible for all activity occurring under your account.

Enrollment begins on the date of purchase. Unless a course page states otherwise, you have 60 days from that date to complete an online course. If the course is not completed within 60 days, access is disabled. An additional 60-day extension is available for $100.00.

Live and electronically streamed classes are governed by the attendance and camera rules set out in our policies, which follow TREC guidelines. Failure to meet those requirements may result in loss of credit for that session.

The School may cancel or reschedule a course as described in our refund policy, and may update course content to reflect changes in law, Commission rules, or industry practice.

Prices are stated in U.S. dollars and are payable in full at checkout. Payments are processed by our third-party payment processor; the School does not store your full card number. By submitting an order you authorize the charge for the total shown, including any applicable fees.

As a Tennessee educational provider, our course tuition is not subject to Tennessee sales tax. Any tax that may apply to a non-educational item will be shown separately at checkout before you pay.

If a payment is reversed, charged back, or declined after access has been granted, the School may suspend access until the balance is resolved.

Membership plans provide optional study tools, practice examinations, analytics, content libraries, and — at certain tiers — coaching. Membership is a study aid. Membership does not, by itself, satisfy any Tennessee pre-licensing or continuing education requirement.

Recurring plans renew automatically at the then-current rate for the stated term until cancelled. You may cancel at any time from your account settings; cancellation stops future charges and access continues through the end of the paid term. Except where required by law, partial periods are not refunded.

The School may change plan pricing or features with notice; changes apply at your next renewal.

The School does not guarantee that you will pass any examination, obtain or retain a license, secure employment, or earn any particular income. Licensure decisions rest solely with the Tennessee Real Estate Commission, and examination results rest with the testing vendor.

Pass Protection is a study-support benefit, not a warranty of any outcome and not a money-back guarantee. If you complete the required study activity — finishing every assigned practice exam and scoring at least 80% on the final simulation — and still do not pass the Tennessee licensing examination, the School will provide free extended access to your study materials together with a structured retake study plan until you pass. Documentation of your examination result is required. The remedy is limited to what is expressly described on the plan page at the time of purchase; no monetary refund is provided unless that page states otherwise in writing, and no employee or instructor is authorized to expand this benefit verbally.

Any statistics we publish regarding student outcomes are historical, are not a prediction of your result, and are not a guarantee.

All course materials — video, audio, slides, workbooks, question banks, drills, playbooks, scripts, templates, newsletters, and site design — are owned by the School or its licensors and are protected by copyright.

Upon enrollment you receive a limited, personal, revocable, non-exclusive, non-transferable license to access the materials for your own education for the duration of your access period. You may not record, screenshot for distribution, download (except where a download is expressly offered), copy, resell, publish, or use our materials to teach or train others, and you may not use our content to train machine learning systems. Question banks and answer keys are especially protected; distributing them undermines the integrity of state-required education.

Students are expected to conduct themselves professionally toward instructors, staff, and fellow students. Harassment, discriminatory conduct, threats, disruption of a live class, and misrepresentation of identity are prohibited.

Prohibited conduct also includes having another person complete coursework or examinations for you, circumventing timers or progress requirements, and falsifying attendance. Violations may result in removal from a class at the instructor's discretion, termination of access without refund, and revocation of certificates.

Certificates of completion and school-issued specialist credentials are issued only when all course requirements are met. Credentials are issued by the School and are not a license, designation, or endorsement of the Tennessee Real Estate Commission or any government body.

The School may verify, suspend, or revoke any credential obtained through misrepresentation, shared access, chargeback, or violation of these Terms. Listings in any public directory we operate are a courtesy, are provided by the licensee, and may be edited or removed at our discretion.

You agree not to interfere with the site's operation, attempt to access accounts or data that are not yours, probe or scan our systems, scrape content in bulk, upload malicious code, or use the site for unlawful purposes. We may suspend access to protect students, staff, or the integrity of our courses.

Our handling of personal information, payment data, cookies, communications, and course completion records is described in the Privacy Policy on our policies page, which forms part of these Terms.

The site references and links to third parties, including the Tennessee Real Estate Commission, the testing vendor, payment processors, insurers, and course hosting platforms. We do not control those services and are not responsible for their content, availability, fees, or policies. Fees and requirements quoted on our site are provided for convenience and may change without notice; always confirm current amounts with the issuing authority.

Course content is educational and general in nature. It is not legal, tax, financial, or brokerage advice, and it does not create an agency or attorney-client relationship. Consult a qualified professional for advice about a specific transaction.

Except as expressly stated in these Terms, the site and course materials are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free access.

To the fullest extent permitted by Tennessee law, the School and its owners, instructors, and staff are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, or lost commissions, arising out of your use of the site or course materials. Our total aggregate liability for any claim is limited to the amount you paid to the School for the course or membership giving rise to the claim in the twelve months preceding the claim.

You agree to indemnify and hold the School harmless from claims arising out of your breach of these Terms, your misuse of course materials, or your conduct as a licensee.

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. The parties agree that the exclusive venue for any dispute is a state or federal court of competent jurisdiction located in Tennessee.

Before filing any action, you agree to first contact the School in writing and allow thirty (30) days to resolve the matter informally. Nothing in these Terms limits your right to file a complaint with the Tennessee Real Estate Commission.

We may update these Terms from time to time. The effective date above reflects the most recent revision. Material changes apply prospectively; continued use of the site or your account after the effective date constitutes acceptance. The version in force at the time of your purchase governs that purchase.
